Disposition Authorities for Individual Classifications for Headquarters Case Files. Part B: Classification 125. Railway Labor Act.

The full title of this classification is Railway Labor Act; Railway Labor Act - Employer's Liability Act. The Bureau opened this classification in July 1948 in response to a memorandum to the Director. Until 1955 the classification contained investigations of the criminal provisions of the Railway Labor Act of 1926. In 1955 Congress passed the Employees Liability Act covering workers' injuries and other accident-related investigations. None of the cases in the sample concerned accidents and the Bureau's jurisdiction for these incidents was removed in 1980. Before 1949 the Criminal Division of the Department of Justice has to give the FBI authority to investigate. Both raliroads and airlines came under the provisions of these acts. Most cases in the sample appear to involve airlines. In 1980, the Bureau instructed Field Offices to advise Headquarters immediately if a controversial or national figure was being investigated.

The FBI established this classification when it assumed responsibility for ascertaining the protection capabilities and weaknesses of defense plants. Each plant survey was a separate case file, with the survey, supplemental surveys, and all communications dealing with a plant insofar as plant protection was concerned, filed together. On June 1, 1941, and January 5, 1942, the Navy and Army, respectively, assumed responsibility for surveying defense plants in which they had interests. Thereafter, ...
